B. Personally Identifiable Information (PII)

We will not sell, rent, or share your PII with third parties for their marketing purposes. Our collection and use of PII are governed by our Privacy Policy.

You grant SmartLab an unlimited, irrevocable, worldwide, perpetual, royalty-free right to use, sell, modify, distribute, and create derivative works from this Aggregated Data for any lawful purpose. This includes, but is not limited to:

• Improving the Service's user experience (UX) and user interface (UI).
• Developing our predictive analytics features.
• Publishing industry reports and insights.
• Providing or selling insights to vendors, manufacturers, or other third parties (e.g., "Makerspaces using Brand Y printers experience 20% less downtime").

3. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or to:

• Upload, post, or transmit any content that is illegal, harmful, or infringing.
• Attempt to gain unauthorized access to our systems or another user's account.

To the maximum extent permitted by law, SmartLab and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• (a) Your access to or use of or inability to access or use the Service;
• (b) Any conduct or content of any third party on the Service;
• (c) Any content obtained from the Service; or
• (d) Unauthorized access, use, or alteration of your transmissions or content.

In no event shall SmartLab's aggregate liability for all claims relating to the Service exceed the greater of one hundred U.S. dollars ($100.00) or the amounts paid by you to SmartLab in the last 12 months for the Service.

7. Indemnification

You agree to defend, indemnify, and hold harmless SmartLab and its employees, officers, and agents from and against any claims, * liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

You agree to resolve any dispute with SmartLab through binding arbitration, not in a court of law. All disputes will be handled individually, and you agree to waive your right to a jury trial and to participate in any class action lawsuit.
